1Introduction

AFK³ currently operates from the Philippines. Personal information may therefore be processed subject to the Republic Act No. 10173, also known as the Data Privacy Act of 2012, its implementing rules and regulations, and other applicable privacy requirements.

Additional privacy or data-protection requirements may apply depending on the location of the relevant individual, client, service provider, or processing activity.

This Privacy Policy should be read together with the AFK³ Terms & Conditions and any applicable project-specific agreement.

Where AFK³ processes personal information on behalf of a client, the client's own privacy policy, instructions, project agreement, Data Processing Agreement ("DPA"), or other applicable contractual arrangement may govern that processing.

In those circumstances, the client may act as the party primarily determining why and how the relevant personal information is processed, while AFK³ processes the information in accordance with the applicable engagement.

This public Privacy Policy is not intended to replace project-specific privacy, security, confidentiality, or data-processing agreements where those are required.

AFK³ uses personal information only for purposes reasonably related to why the information was collected, unless another lawful basis permits or requires additional processing.

6Lawful Basis for Processing

Where applicable, AFK³ processes personal information only when there is an appropriate lawful basis or legal justification.

Depending on the circumstances, this may include:

  • Compliance with legal obligations;
  • Protection of lawful rights and interests;

  • Other grounds permitted under applicable privacy legislation.

The appropriate basis depends on the nature of the information and processing activity. Consent is not represented as the legal basis for every processing activity where another lawful basis actually applies.

The Discuss Your Project form may request information such as:

  • Name;
  • Business email;
  • Company;
  • Company website;
  • Country;

Submitting an inquiry does not create a client engagement or obligation for AFK³ to provide services.

Submission of the project inquiry form is not used as automatic consent for unrelated promotional email campaigns.

8Cookies & Similar Technologies

AFK³ may use cookies and similar technologies where necessary for website operation, security, user preferences, analytics, or other disclosed purposes.

Essential Cookies

Essential cookies may be used where required to provide core website functionality, maintain security, prevent abuse, or remember necessary user preferences.

Analytics Cookies

AFK³ may use analytics technologies to understand how visitors interact with the website and improve website performance.

Advertising & Marketing Trackers

If AFK³ later installs advertising pixels, retargeting technology, cross-site tracking, or similar marketing tools, this Privacy Policy will be updated and any consent mechanism required by applicable law will be implemented before activating them.

Cookie Consent

Where the website uses only strictly necessary technologies, no cookie-consent banner is presented for appearance alone. If non-essential analytics, advertising, or tracking technologies are used and consent is legally required, an appropriate cookie-consent mechanism is implemented before those technologies load.

9Analytics

AFK³ may use privacy-appropriate analytics to understand website traffic and performance. Where disclosure is required, the final policy identifies the analytics services actually used.

10Artificial Intelligence Services

AFK³ develops and may use artificial-intelligence technologies in its business and client solutions. Certain services or internal workflows may involve third-party AI providers.

Where personal, confidential, or client information is submitted to an AI service, AFK³ considers:

  • Whether the processing is necessary;
  • The sensitivity of the information;
  • The provider's data-handling terms;
  • Applicable client instructions;
  • Applicable contractual restrictions;
  • Available privacy and retention controls; and
  • Applicable legal requirements.

AFK³ does not make a blanket statement that all information submitted to AFK³ is used to train artificial-intelligence models.

Where AI functionality forms part of a client solution, data handling is governed by the applicable project architecture, provider arrangements, project agreement, DPA, and/or other applicable documentation.

Clients should avoid supplying unnecessary sensitive personal information through general inquiry forms.

  • AI integrations;
  • API integrations;
  • Managed operations;

  • Related technical services.

The client may determine the purposes for which such data is collected and processed.

Where AFK³ acts on the client's instructions, AFK³ will process the relevant information according to the applicable agreement and documented instructions, subject to legal requirements.

Depending on the project, AFK³ and the client may need a separate:

  • Data Processing Agreement;
  • Data-sharing agreement;
  • Security schedule;
  • Confidentiality agreement;
  • Data-retention schedule; or
  • Other privacy/compliance documentation.

The public website Privacy Policy is not a substitute for those project-specific arrangements.

12Contractors, Specialists & Remote Personnel

AFK³ may use appropriately authorized employees, contractors, specialists, remote personnel, or delivery partners to perform portions of its services.

Where such personnel require access to personal or confidential information, AFK³ limits access according to legitimate project and operational needs and applies appropriate contractual, confidentiality, access-control, or security requirements.

Access follows the principle that personnel should receive only the information reasonably necessary to perform their assigned responsibilities.

Information may be shared where reasonably necessary with:

  • Authorized AFK³ personnel;
  • Contractors or specialists supporting an engagement;
  • Hosting / cloud providers;
  • Business software providers;
  • Payment or financial service providers;
  • Professional advisers;
  • Client-authorized third parties;
  • Government authorities where legally required; or
  • Other parties where disclosure is permitted or required by applicable law.

AFK³ limits disclosures to information reasonably necessary for the relevant purpose.

AFK³ may also disclose information where reasonably necessary to protect legal rights, investigate suspected fraud or abuse, respond to a security incident, enforce agreements, or comply with lawful processes.

15Sale of Personal Information

AFK³ does not sell personal information as a standalone business model.

If AFK³'s business practices materially change in a way that constitutes the sale or regulated sharing of personal information under an applicable law, this Privacy Policy and any required privacy controls will be updated before or when such practices begin.

16International & Cross-Border Processing

AFK³ operates from the Philippines and may work with clients, personnel, infrastructure providers, and technology providers located in other countries.

As a result, personal information may be processed or stored outside the country in which the relevant individual is located.

Where cross-border processing occurs, AFK³ takes reasonable measures required by applicable law and contractual arrangements to ensure appropriate handling of personal information.

Project-specific requirements concerning data location, hosting region, international transfers, or data residency are identified during project planning and documented in the applicable agreement.

17Data Security

AFK³ takes reasonable technical and organizational measures intended to protect personal information against unauthorized access, disclosure, alteration, loss, misuse, or destruction.

Depending on the relevant system and risk, measures may include:

  • Access controls;
  • Authentication;
  • Credential-management practices;
  • Encryption where appropriate;
  • Secure hosting configurations;
  • Software updates;
  • Backups;
  • Logging and monitoring;
  • Restricted personnel access;
  • Confidentiality obligations;
  • Secure development practices; and
  • Other appropriate safeguards.

However, no internet transmission, software system, cloud service, or storage method can be guaranteed to be completely secure. AFK³ therefore cannot guarantee absolute security.

18Data Retention

AFK³ retains personal information only for as long as reasonably necessary for the purpose for which it was collected and for legitimate business, contractual, security, dispute-handling, recordkeeping, or legal requirements.

Retention periods may vary depending on:

  • Type of information;
  • Purpose of processing;
  • Client relationship;
  • Contract requirements;
  • Legal obligations;
  • Security requirements;
  • Dispute or claim periods; and
  • Technical backup cycles.

When information is no longer reasonably required, AFK³ deletes, anonymizes, securely disposes of, or otherwise appropriately manages it according to applicable requirements and technical capabilities.

Project-specific retention requirements may be defined separately.

19Data Subject Rights

Subject to applicable law, individuals may have rights concerning their personal information. These may include rights to:

  • Be informed about processing;
  • Request access to personal information;
  • Request correction of inaccurate or incomplete information;
  • Object to certain processing;
  • Request deletion, blocking, or erasure where legally applicable;
  • Withdraw consent where processing is based on consent;
  • Request data portability where applicable;
  • Raise concerns regarding processing; and
  • Exercise other rights provided by applicable privacy law.

Certain rights may be subject to legal exceptions, contractual requirements, identity verification, or legitimate retention obligations.

To exercise a privacy right, contact AFK³ using the details in the Contact & Privacy Requests section. AFK³ may need to verify the requester's identity before processing certain requests to protect information from unauthorized disclosure.

20Marketing Communications

AFK³ may communicate with existing or prospective business contacts where permitted by applicable law.

Where consent is required for marketing communications, AFK³ obtains appropriate consent. Individuals are provided with a reasonable way to opt out of promotional communications where required.

Transactional, project, security, account, contractual, or service-related communications may still be sent where necessary even if an individual opts out of unrelated promotional marketing.

Project-inquiry users are not automatically enrolled into newsletters or promotional mailing lists unless an appropriate opt-in mechanism has been provided.

21Sensitive Personal Information

General website inquiry forms do not intentionally request sensitive personal information unless there is a legitimate and lawful reason to do so.

Visitors should avoid submitting unnecessary sensitive information through general website forms.

If a client project requires processing sensitive or highly confidential information, AFK³ and the client address appropriate privacy, security, access, retention, and contractual safeguards during project planning.

22Children's Privacy

AFK³'s website and business services are intended primarily for businesses and professional users and are not directed toward children.

AFK³ does not intentionally design its general business inquiry process to collect personal information from children.

If AFK³ becomes aware that personal information relating to a child has been collected in circumstances requiring deletion, consent, or other protective measures, AFK³ will take appropriate action in accordance with applicable law.

23External Links

The AFK³ website may contain links to external websites or third-party services.

AFK³ does not control the privacy practices of independent third-party websites. Visitors should review the privacy notices of external services before providing personal information to them.

The inclusion of a link does not by itself mean AFK³ controls or accepts responsibility for that third party's privacy practices.

24Business Transfers

If AFK³ undergoes a merger, acquisition, restructuring, financing, sale of assets, or similar business transaction, information may be transferred as part of that transaction where legally permitted.

Any receiving party is required to handle relevant personal information in accordance with applicable privacy obligations.

25Data Breaches & Security Incidents

AFK³ maintains reasonable processes for identifying, assessing, containing, and responding to suspected personal-data security incidents.

Where a security incident creates notification obligations under applicable law or contractual arrangements, AFK³ provides required notifications to affected parties or authorities within applicable requirements.

26Changes to This Privacy Policy

AFK³ may update this Privacy Policy to reflect changes in:

  • Business practices;
  • Website functionality;
  • Technology;
  • Service providers;
  • Data-processing activities;
  • Legal requirements; or
  • AFK³ services.

The current version displays its effective or last-updated date. Material changes are communicated where required by applicable law.

Continued website availability of the policy does not eliminate any requirement to obtain consent where consent is legally required for a new processing activity.
